Term of Service

FarmiSpace is a product service of Datayoo Applications Co., Ltd. (hereinafter referred to as "the Company"). Users shall read and agree to the following terms of service before using FarmiSpace. When you (hereinafter referred to as the "User") register as a FarmiSpace member and use related services or features (hereinafter referred to as the "Services"), you acknowledge that you have thoroughly reviewed and understood all terms for more than three days, agree to be bound by these Terms of Service (hereinafter referred to as the "Agreement"), and shall comply with relevant legal regulations, including any subsequent amendments thereto.

If you are a minor with limited capacity for civil conduct, or a person who requires parental, legal representative, or guardian consent under applicable laws (such as the Children's Online Privacy Protection Rule (COPPA)) or the governing law of this Agreement (Laws of Taiwan), you must have your parent, legal representative, or guardian review this Agreement and obtain their consent before checking "I agree." If you have no capacity for civil conduct, your parent, legal representative, or guardian must review this Agreement and check "I agree" on your behalf before you may register and use the Services. Once you complete registration and begin using the Services, it shall be deemed that your parent or guardian has read, understood, and agreed to the terms of this Agreement. Regarding parents, legal representatives, or guardians, particularly those subject to COPPA, FarmiSpace may employ external verification methods (including but not limited to SMS, fax, video, email, or credit card verification) to verify explicit consent from parents, legal representatives, or guardians.

Furthermore, please be advised that the provisions of this Agreement may be modified at any time. Please regularly check the announcements on the Services and official website. If you do not agree to the following user agreement terms and their modifications, please cease using any of the Services immediately. Your continued use of the Services indicates your acceptance of this Agreement. If you have any questions, please contact us immediately.

I. Membership Qualification and Account Security

  • This website primarily provides land data monitoring and analysis services.
  • The term "Member" under these Terms of Service refers to individuals who have applied through the website's membership registration process and passed verification.
  • Users must register as FarmiSpace members before using the services, and membership registration is free of charge. Users may apply for a new account through a valid email address.
  • If a user's email address is found to be invalid, FarmiSpace reserves the right to suspend such user's account and may delete or remove any files or data associated with that account without liability. If users encounter registration or payment refund issues due to the use of invalid email addresses, subsequent processing will only commence after the user re-submits and confirms a valid email address, and after verification that the reapplied account belongs to the user who filed the complaint.
  • Upon registering as a FarmiSpace member, users are deemed to have consented to receive any and all emails or newsletters sent by FarmiSpace. Users are only required to pay fees when ordering or purchasing FarmiSpace services, and the related fee schedules and systems are considered part of this Agreement.
  • This website reserves the right to review membership qualification applications. Furthermore, for existing members, this website may act in accordance with the provisions of these Terms of Service and applicable laws.
  • When you use this website's services, you agree to comply with the provisions of these Terms of Service and applicable laws.
  • These Member Terms of Service and any amendments thereto shall apply to all members. When this website amends these Terms of Service, such amendments will be announced on this website, and members' continued use of this website following such announcement shall constitute acceptance of the amended Terms of Service.

II. Privacy Protection

  • By becoming a member of this website, you agree to the Privacy Policy established by this website.

III. Member Registration Data

  • To effectively provide member services, this website requires members to provide registration data, including personal basic information, contact information, and payment details.   • For the purposes of marketing, market analysis, statistics, or research, members agree that the Company or its strategic partners may record, retain, and utilize data and records left or generated by members on this website, and may publicly disclose or use statistical data without revealing members' names, addresses, or email information.

IV. Member Conduct

  • All member activities using this service must comply with relevant local, Company's jurisdictional, and international laws and regulations. Members shall not use this website and its derivative services to infringe upon others' rights or engage in illegal activities.
  • When using the membership services provided by this website, members shall not:
    • a. Engage in content that damages others' personality rights, trademarks, copyrights, other intellectual property rights, or other rights.
    • b. Use text that violates public order, morality, or is otherwise illegal.
    • c. Make extreme political or religious statements.
    • d. Engage in other content that violates this website's "Terms of Service."
  • Your account password is for your personal use only. Do not share your account password with others, and you should properly safeguard your account password. You may modify your password through mechanisms provided by FarmiSpace. FarmiSpace official staff, event personnel, and online service administrators will never proactively request your password information. If you encounter such situations, please report them to the Company immediately.
  • If members discover their account or password has been stolen, illegally used, or any abnormal security breach has occurred, they shall immediately notify the Company to enable appropriate measures to be taken. However, any measures taken by the Company shall not be interpreted as an express or implied guarantee or liability for compensation by the Company. The Company shall not be liable for any compensation regarding illegal use of members' accounts and passwords. Members shall bear all legal responsibility if false reports cause damage to the Company or third parties' rights.
  • Upon receiving the notification mentioned in the preceding paragraph, the Company may temporarily suspend the member's account usage rights and temporarily restrict third-party service-related rights. Related handling procedures will be detailed in the service management rules. The Company will post a notice on the official website requesting explanation from third parties. If said third party fails to provide an explanation within seven (7) days of the announcement, the Company will directly restore the electromagnetic records transferred from the member's account. If electromagnetic records cannot be restored, the Company will provide alternative compensation. However, if the account theft, illegal use, or other abnormal breach occurs due to the member's failure to use the Company's free security measures or other reasons attributable to the member, the Company will neither restore the account nor provide alternative compensation.
  • The Company may decline to assist in resolving disputes between members and third parties arising from shared accounts, commissioned purchases, or other member negligence.
  • Members agree and warrant that they shall not publish, distribute, or transmit any defamatory, false, threatening, indecent, obscene, illegal, personal attacks, or racially/nationally discriminatory statements or information on the service, official fan pages, or other public venues that may infringe upon the rights, interests, or intellectual property rights of the Company, service agents, or others. Members shall not post statements regarding buying or selling service accounts and agree to be responsible for all text and image content they publish and transmit on the service.
  • Members warrant that they will never impersonate Company-related organizations, employees, or customer service personnel, and will comply with instructions regarding the service given by authorized Company personnel.
  • To further manage and maintain FarmiSpace service quality, members agree that when they use plug-ins, virus programs, service program vulnerabilities, or other methods that violate fair and reasonable service usage, the system may automatically retain records of violations of this Agreement or service management rules. These records include CPU type, operating system type, operating system version, computer name, computer ID, improper program access paths, and other data.

V. Intellectual Property Protection

  • All software, programs, and website content used by this website, including but not limited to works, images, files, information, data, website architecture, and webpage design, are legally owned by this website or other rights holders as intellectual property rights, including but not limited to trademark rights, patent rights, copyrights, trade secrets, and proprietary technology.
  • General members shall not directly use, modify, reproduce, publicly broadcast, adapt, distribute, publish, publicly present, reverse engineer, decompile, or disassemble. To quote or reprint the aforementioned software, programs, or website content, prior written consent must be legally obtained from this website or other rights holders. Members shall not employ any method to provide operational (or hosting) services, intermediary services, or intercept, simulate, or redirect the service. These prohibited methods include but are not limited to setting up private servers, reverse engineering, modifying the service, or adding new components, nor shall they use certain tool programs to provide service operation (or hosting) services. In case of violation, you shall be liable for damages to this website or other rights holders (including but not limited to litigation costs and attorney fees), and shall pay the Company punitive damages of NTD 500,000.

VI. Company Proprietary Rights

  • All software or content contained on or linked to this website, or content provided by the Company's advertisers and partners, are protected by their copyright or other proprietary rights or laws. For content provided by companies, operators, or vendors with cooperative relationships with the Company, the Company, respecting others' intellectual property rights and other interests, does not conduct any substantive review of their provided content. Members should carefully judge the accuracy and reliability of the content. If the content is false or erroneous, you should directly reflect this to the content provider. The Company makes no warranties regarding this.
  • The Company agrees that except as stipulated in these Terms of Use, it will not illegally transfer the aforementioned member data and derivative works placed on this website for other direct profit purposes that would infringe upon your rights, beyond making them available for internet users to browse on this website and the Company's related media.
  • All content, advertising boards, and activity messages appearing on all webpages of this website are owned and operated by the Company or companies, operators, or vendors with cooperative relationships with the Company. Users may not use all or part of the content or messages without prior consent from the Company.

VII. Termination of Authorization

  • If a member's use of the service violates any laws, these Terms of Use, or potentially endangers the rights of this website or third parties, the Company has the right to temporarily or permanently terminate the member's authorization to use the service without notice. The aforementioned harmful actions include: (1) malicious attacks or destruction of the Company's computer systems or servers using any system or tool; (2) using plug-ins, virus programs, service program vulnerabilities, or other methods that violate service normal settings or fair and reasonable usage; (3) paying for services through impersonation, fraud, or other false means; (4) impersonating this website, the Company, official personnel, or cooperative entities; (5) being found engaging in any illegal activities by any local judicial or administrative authority; (6) other actions violating fair internet usage principles. Upon notification from any local judicial or administrative authority, the Company may immediately suspend the member's authorization to use the service; after judicial or administrative proceedings conclude confirming no illegal activities, members may apply to the Company for restoration.

VIII. Termination of Membership and Company's Notification Obligations

  • The Company has the right to modify service content or terminate any member account service.
  • If a member decides to terminate their Company membership, they can notify the Company directly via email or through mechanisms provided by the Company for cancellation, and the Company will cancel your member information as soon as possible.
  • Members have the obligation to notify the cancellation of Company membership, and from the date of membership termination (based on the Company's email sending date), all privileges and rights provided by this service will be forfeited.
  • To prevent malicious incidents resulting in loss of member rights, when members notify the Company to terminate membership, the Company will reconfirm via email before proceeding with membership cancellation.

IX. Disclaimer

  • FarmiSpace will maintain its computer systems with reasonable security standards according to current technological and professional levels. However, members understand and agree that the service may experience interruptions, malfunctions, hardware damage, connection failures, or hacker intrusions. These phenomena may cause user inconvenience, service execution delays or progress rollbacks, data loss, third-party tampering, or other derived economic losses, all of which shall be borne by members. Therefore, members are advised to take their own protective measures.
  • The website has the right to stop or interrupt service provision under the following circumstances:
    • a. When replacing, upgrading, maintaining, or working on service-related hardware and software.
    • b. When the Company's server electronic communication service experiences issues or undergoes maintenance, resulting in communication failure. If server overload prevents personal records from being written, members agree that the Company may restart the server to restore service to its pre-overload state.
    • c. When sudden electronic communication equipment failures occur.
    • d. When natural disasters or other force majeure factors prevent the website from providing services.
    • e. When service stoppage or interruption occurs due to reasons not attributable to the Company.
  • The Company shall not be liable for any direct, indirect, or derivative property or non-property damages arising from users' use of the website.
  • The Company makes no warranty regarding the purpose of using this service or the results produced, nor does it guarantee that software related to this service is free from defects or will be corrected.
  • All statements, opinions, or actions by members on this site represent only the individual member; they do not represent the Company's position, and the Company bears no responsibility. The Company does not guarantee the accuracy of members' self-claimed identities.
  • The Company shall not be responsible to members or any person for any threats, defamation, obscenity, or other illegal acts occurring on or through the service.
  • All fees exclude any applicable taxes; except for taxes on FarmiSpace's income, you must separately bear and pay sales tax, use tax, goods and services tax (GST), value-added tax, withholding tax, or similar taxes or duties, including both domestic and foreign taxes, as described in these terms. You must pay all fees due under these terms without offset, counterclaim, deduction, or withholding. If payments you owe under these terms are subject to deduction or withholding, you are responsible for paying the appropriate tax authorities the required amounts; you shall also bear any interest, penalties, fines, or similar obligations if such taxes are not remitted to the appropriate government authorities or agencies in a timely manner. You acknowledge and accept that when accessing and using the service, you are located at the billing address listed in these terms or provided to us in writing. You agree to indemnify us for any taxes, penalties, and interest that you fail to pay in full or are in arrears.
  • The satellite data and geographic information provided by the service may be affected by:
    • a. Satellite constellation differences: Different satellite constellations have varying technical specifications, orbital characteristics, and update mechanisms, which may result in significant differences in image update frequency. Users should understand that update cycles for different satellite data may be inconsistent and timeliness cannot be guaranteed.
    • b. Cloud cover: Natural weather conditions, especially cloud coverage, may result in incomplete or missing image data for certain geographic areas. We cannot guarantee complete geographic image information under cloud cover conditions.
    • c. Data limitations: Due to the above technical and natural factors, satellite data and geographic information provided by the service may be incomplete, not real-time, or partially missing, and users should carefully evaluate data applicability.
  • The Company's total liability is limited to compensating members for actual direct losses incurred through reasonable use of the service, with compensation capped at the amount actually paid by members for the service.
  • By using this service, you agree to accept the aforementioned limitations and disclaimers.

X. Protection of Minors

  • To promote the healthy physical and mental development of children and adolescents and protect their related rights, users understand and should be aware of relevant legal requirements regarding age restrictions for using this level of service. If you do not meet the age requirements, please stop using this service. If users click the "Agree" button or begin accessing the service, it is presumed that users meet the legal age requirements for using this level of service. Even those who meet or are presumed to meet the age requirements may not distribute, circulate, sell, rent, give, or lend service content to persons who do not meet the age requirements, nor display, play, or screen service content to such persons.

XI. Service of Notice

  • Regarding all matters related to this Agreement, members agree that the Company may effect service through announcements on the service website homepage, service login page, or through the contact information registered by members; if members' registered contact information changes, members shall immediately notify the Company.
  • If the Company chooses to send notices based on members' registered contact information, such notices are presumed to have been legally served upon sending.
  • The Company shall not be liable for any damages to members due to inability to serve notice caused by members' intentional acts or negligence.

  • FarmiSpace reserves the right to add, modify, or delete all or part of the service, and will announce such changes on the service page or official webpage without individual notification. You agree not to request any compensation or damages for this, and will be bound by such revised terms from the time of their announcement. Once you continue to use the service after the announcement, you are deemed to have agreed to the revised terms. FarmiSpace and service providers shall not be liable to any member or third party for any inconvenience, inconvenience, or damage that may arise from adding, modifying, or deleting all or part of the service.
  • This website's user agreement and disclaimer content also constitute part of these Terms of Use.
  • This Agreement's content, access and use of the Company's website, applications (including API and APP), and their affiliated website activities and participation in other network connection activities shall be governed by Taiwan (TAIWAN) law. If any terms in this Agreement are inconsistent with mandatory regulations in your jurisdiction and local legal regulations exclude the application of the aforementioned governing law, please follow local legal regulations. If any part of this Agreement is invalid, it does not affect the validity of other parts. All disputes arising from the use of this service shall be subject to the jurisdiction of the Taiwan Shilin District Court as the court of first instance.
  • Members agree that when negotiating and concluding supplementary terms with the Company, they are aware that all information including the Company's undisclosed business information, trade secrets, confidential information, activity planning, business decisions, related contract content (including but not limited to supplementary terms agreements), and the process of negotiating and concluding supplementary terms are confidential matters, and may not directly or indirectly disclose to any third party or assist third parties in obtaining such information without the Company's written consent.
  • If any member's use of this service leads to investigation or prosecution of the Company by third parties or administrative authorities, the Company has the right to claim damages from the member, including but not limited to litigation costs, attorney fees, and loss of goodwill.
  • The Company will notify members through appropriate means before any foreseeable hardware and software maintenance work that may cause system interruption or suspension.
  • If there are different language versions of these Agreement terms, the "Traditional Chinese" version shall prevail. In case of doubt regarding text interpretation or application, the "Traditional Chinese" version shall also prevail.
